FINAL CERTIFICATION

On December 20, 2021, UW Researchers United/UAW 4121 filed a petition to represent certain employees of the University of Washington. After an investigation, the Public Employment Relations Commission (PERC) determined that an election could be conducted and reserved the eligibility challenges for a subsequent determination. The tally indicated that the UW Researchers United/UAW 4121 was entitled to certification and the eligibility issues did not affect the outcome of the election. PERC issued an interim certification in University of Washington, Decision 13519 (PECB, 2022) and conducted further proceedings to resolve the eligibility challenges.

After hearing, the Executive Director determined that certain challenged positions should be included and excluded in the bargaining unit. University of Washington, Decision 13519-A (PECB, 2022) and University of Washington, Decision 13519-B (PECB, 2022). Neither party appealed the Executive Director’s decisions.

Subsequently, the parties resolved their remaining differences without the need of additional hearing dates. PERC has reviewed the parties’ resolution and determined that the resulting bargaining unit is appropriate under the statute. No further proceedings are necessary.

ORDER

1.                  The interim certification will stand as the final certification in this representation proceeding for the bargaining unit described as follows:

All full-time and regular part-time employees of the University of Washington in the following job classes: Research Scientist/Engineer – Assistant; Research Scientist/Engineer – 1; Research Scientist/Engineer – 2; Research Scientist/Engineer – 3; Research Scientist/Engineer – 4; excluding confidential employees, supervisors, managers as defined by RCW 41.56.021(1)(b), employees covered by chapter 41.80 RCW, employees covered by chapter 41.76 RCW, and all other employees.

2.                  The above-captioned matter is CLOSED.
