On October 26, 2020, the Resident & Fellow Physician Union – Northwest (union) filed a unit clarification petition requesting to amend an existing bargaining unit certification to reflect the exclusive bargaining representative’s name change. The request is granted.

The union represents the following employees in the University of Washington School of Medicine: residents and fellows in ACGME-accredited programs (which, as of August 28, 2014, includes Residents, Fellows, Chief Residents, Fellow/Senior Fellow Trainee Dual Appointments, and Resident/Senior Fellow Trainees dual appointments); Otolaryngology Research Residents; Surgery Research Residents; Urology Research Residents; Gynecologic Oncology Fellows; Adult Congenital Heart Disease Fellows; and Maternal Fetal Medicine Fellows. The bargaining unit also includes the residents in the University of Washington School of Dentistry. When the unit was originally certified, the union’s name was University of Washington Housestaff Association. The union has rebranded and changed its name to Resident & Fellow Physician Union – Northwest.

A party may file a petition to amend an existing certification. The Executive Director may amend the certification if the purpose of the amendment is to reflect a name change of the labor organization, the bargaining unit is not affected by the change, and there are no questions concerning representation. WAC 391-35-085. The union’s petition merely seeks to amend the existing certification to accurately reflect the union’s name. The bargaining unit’s structure has not been altered, and the petition does not include a question concerning representation.

ORDER

 

1.      The bargaining unit was certified in University of Washington, Decision 12064-B (PECB, 2014) and is described as:

 

Included: In the University of Washington School of Medicine: All residents and fellows in ACGME-accredited programs (which, as of August 28, 2014, includes Residents, Fellows, Chief Residents, Fellow/Senior Fellow Trainee Dual Appointments, and Resident/Senior Fellow Trainees dual appointments); Otolaryngology Research Residents; Surgery Research Residents; Urology Research Residents; Gynecologic Oncology Fellows; Adult Congenital Heart Disease Fellows; and Maternal Fetal Medicine Fellows.

In the University of Washington School of Dentistry: Residents.

 

Excluded: All other employees of the University of Washington, including any person holding a faculty appointment or dual faculty appointment; Rehab/Physical Therapy Students; School of Pharmacy Residents; Senior Fellow Trainees; Senior Fellows; Non-ACGME Chief Residents, supervisors, and confidential employees.”

 

The certification is amended to reflect that the certified bargaining representative has changed its name to the Resident & Fellow Physician Union – Northwest.

 

2.                  The amendment to the certification issued in this proceeding does not give rise to a new “certification bar” year under RCW 41.56.070 or WAC 391-25-030(2).
