On October 3, 2017, UW Postdocs United/International Union, United Automobile, Aerospace and Agricultural Implement Workers of America, Local Union 4121 filed a representation petition with the Public Employment Relations Commission involving certain employees of the University of Washington.  As a result of preliminary processing of the petition, the Commission determined the question concerning representation and reserved the issues concerning the eligibility of certain employees for inclusion in the bargaining unit for a subsequent determination.  The tally indicated that UW Postdocs United/International Union, United Automobile, Aerospace and Agricultural Implement Workers of America, Local Union 4121 was entitled to certification in the matter and that the reserved eligibility issues were not of a sufficient number to affect the outcome of the proceedings.

 

An interim certification was issued in this matter, University of Washington, Decision 12838-A (PECB, 2018), for a bargaining unit described as:

 

All postdoctoral employees as defined by RCW 41.56.513 employed by the University of Washington, excluding confidential employees, employees covered by Chapter 41.76 RCW, and all other employees.

 

The proceeding was held open to resolve the eligibility disputes previously framed by the parties.

 

Prior to issuance of a decision on the eligibility issues, the parties resolved the eligibility issues.  The agreements resulted in a slight modification to the bargaining unit description, which was acceptable to the Commission.  It therefore appears that all issues that could properly be addressed in this representation proceeding have been resolved and that no further proceedings are necessary.

 

                                                                        ORDER

 

1.         The bargaining unit description in this matter will be modified as follows:

 

            All postdoctoral scholars employed by the University of Washington, excluding confidential employees; employees covered by Chapter 41.76 RCW; employees privileged as attending physicians within the context of their University responsibilities; employees enrolled in clinical residency and fellowship programs in health sciences; employees engaged in research related to their clinical training program; individuals employed by non-University entities (e.g., individuals paid directly by the Howard Hughes Medical Institute, the U.S. Department of Veterans Affairs, the Fred Hutchinson Cancer Research Center, and the U.S. Military); and all other employees.

 

2.         The above-captioned matter is CLOSED.
