ORDER OF DISMISSAL

On May 3, 1989, the Kirkland Public Employees Guild (complainant) filed a complaint charging unfair labor practices with the Public Employment Relations Commission, alleging that the City of Kirkland (respondent) had violated RCW 41.56.140(4) by making a unilateral change in overtime compensation practices.

The matter was reviewed by the Executive Director pursuant to WAC 391-45-110, and it was determined that the statement of facts accompanying the complaint indicated the existence of a waiver of bargaining rights by inaction. The complainant was informed in a letter dated August 23, 1989, that such a waiver constituted a key defect in the complaint, making it appear that the complaint would be dismissed on its merits. The complainant was given a period of 14 days in which to file an amended complaint, or face dismissal of the instant case. No amended complaint or additional information has been filed.

ORDER

The complaint charging unfair labor practices filed in the above-captioned matter is hereby DISMISSED.
