STATE OF WASHINGTON

BEFORE THE MARINE EMPLOYEES’ COMMISSION

OFFICE AND PROFESSIONAL EMPLOYEES INTERNATIONAL UNION, LOCAL 8, on behalf of GLYNIS WILSON,

MEC CASE NO. 61-04

DECISION NO. 432 - MEC

Grievant,

v.

WASHINGTON STATE FERRIES,

ORDER OF MEDIATION RESULTS AND CLOSING MEC FILE ON UNRESOLVED GRIEVANCE

Respondent.

Shannon Halme, Union Representative, appearing for Office and Professional Employees International Union, Local 8.

Christine Gregoire, Attorney General, by David Slown, Assistant Attorney General, appearing for Washington State Ferries.

THIS MATTER came on regularly before the Marine Employees’ Commission (MEC) on May 11, 2004, when Shannon Halme, Union Representative for Office and Professional Employees International Union, Local 8 (OPEIU) filed a request for grievance mediation concerning WSF’s termination of Glynis Wilson.

The request for grievance mediation was docketed as MEC Case No. 61-04. Commissioner John Sullivan was assigned to act as Mediator. The parties participated in settlement conferences on June 15 and August 18, 2004. On September 23, the union received additional requested information from WSF and subsequently asked that another settlement conference be scheduled. A conference was scheduled for December 8, but was rescheduled to November 16, 2004 due to a conflict with an interest arbitration date for the WSF.

The matter was not resolved during the November 16 settlement conference; the OPEIU indicated it would move the grievance to arbitration. By letter on December 3, 2004, OPEIU notified the MEC that the union has filed with the Federal Mediation and Conciliation Service for grievance arbitration, pursuant to Article 15 of the OPEIU/WSF contract.

ORDER

It is hereby ordered that the MEC’s file on the request for grievance mediation filed by the OPEIU Local 8 and docketed as MEC Case No. 61-04, is closed.

DATED this 10th day of December 2004.
