THIS MATTER coming before the Commission on Complainant’s Petition for Review of the Chairman’s Decision No. 221-MEC, dated December 10, 1999 and such decision and the written positions of the parties here of record, with respect to such review, having been fully considered and good cause appearing therefor, the charge of unfair labor practice herein, as lodged by Complainant, should be dismissed on the ground and for the reason that, under the law, such charge was untimely and, in any event, was based on alleged negligence, which, in itself, under the applicable and governing law, should not and does not describe an “actionable” unfair labor practice.
WHEREFORE, it is ordered herewith that said decision of the Chairman, No. 221-MEC, in this matter should be and hereby is affirmed and validated in all respects and particulars and Complainant’s charge of unfair labor practice, against Respondents, is dismissed definitively, as by that decision specified.
