ORDER DENYING WSF’S REQUEST FOR STAY OF ORDER

Respondent.

 

On May 15, 1998, the Washington State Ferries (WSF), Respondent herein, filed a Request for a Stay of Order entered in Decision No. 194 - MEC, Inlandboatmen’s Union of the Pacific v. Washington State Ferries, MEC Case No. 31-97, with the Marine Employees’ Commission (MEC). Decision No. 194 - MEC was entered and mailed to the parties on April 15, 1998. The Request for Stay of Order, made pursuant to RCW 34.05.550, requested that the implementation of Decision 194 - MEC be stayed pending entry of a final order in the WSF’s Request for Judicial Review, filed in Thurston County Superior Court on May 14, 1998.

On June 2, 1998, the Inlandboatmen’s Union of the Pacific (IBU), Complainant herein, filed their opposition to WSF’s Request for Stay with the Commission.

Based upon MEC’s review of the Respondent’s request, the Complainant’s opposition and the arguments submitted in support thereof, the MEC concludes that a stay is not warranted.

It is therefore ordered that Washington State Ferries’ Request for a Stay of Order be denied.
