THIS MATTER came before the Marine Employees’ Commission on September 26, 1995 when the Office and Professional Employees’ International Union filed an unfair labor practice complaint against the Washington State Ferries.

OPEIU’s complaint charged WSF with engaging in unfair labor practices within the meaning of RCW 47.64.130(1) by refusing to bargain collectively with representatives of employees.

Specifically, OPEIU alleged that on August 31, 1995, OPEIU Local 8 was informed by Inlandboatmen’s Union of the Pacific representative Dennis Conklin that Washington State Ferries was requiring IBU members working in Public Information to perform OPEIU Reception functions from 8:00 to 8:30 a.m., Monday through Friday. On September 7, 1995 OPEIU sent a letter requesting to meet with Jim Yearby, WSF Director of Employee Relations. Mr. Yearby met with Dennis Conklin and OPEIU representative James J. Johnson on September 19, 1995. At that time, Mr. Yearby stated that the reason IBU members were performing OPEIU work was that the hours worked by the temporary OPEIU reception had been changed from 8:00 a.m. to 4:00 p.m. to 8:30 a.m. to 5:00 p.m. OPEIU alleges the union was never notified by the WSF of the intention to have IBU members perform OPEIU receptionist functions. OPEIU alleged that by this conduct, WSF refused to bargain the impact of these changes with OPEIU, in violation of 47.64.130(1)(e).

The matter was docketed as MEC Case No. 17-95. Letters acknowledging receipt of the ULP complaint were sent to the parties. Copies of the complaint were distributed for review and processing by the MEC.

On October 3, 1995, MEC received a letter from OPEIU representative James Johnson requesting withdrawal of the matter.

ORDER

It is hereby ordered that the unfair labor practice complaint, filed by OPEIU against WSF and docketed as MEC Case No. 17-95, is dismissed without prejudice.
