THIS MATTER came before the Marine Employees’ Commission on May 26, 1995 when the Inlandboatmen’s Union of the Pacific filed an unfair labor practice complaint against the Washington State Ferries.

IBU’s complaint charged WSF with engaging in unfair labor practices within the meaning of RCW 47.64.130(1) by interfering with, restraining or coercing employees in the exercise of rights and refusing to bargain collectively with representatives of employees.

Specifically, IBU alleged that WSF unilaterally altered terms and conditions of employment without notice or bargaining with the union when it disciplined Barry Weger twice for activities alleged against him ticket selling at the Southworth Terminal (which constitutes double jeopardy), and when it allowed Mr. Weger to transfer to another dock and dump into a ticket taker position there.

The matter was docketed as MEC Case No. 6-95. The Commission subsequently determined, pursuant to WAC 315-45-110, that the facts Alleged may constitute unfair labor practices if later found to be true and provable. Chairman Henry L. Chiles, Jr. was appointed to act as hearing examiner.

On June 9, 1995 Dennis Conklin, IBU, notified MEC, by phone, that the parties had reached an agreement and the union would be withdrawing its complaint.

On June 22, 1995, MEC received written notice of withdrawal of the complaint filed by Dennis Conklin, IBU Business Agent. A copy of the parties’ agreement is appended to and included in this Decision and Order by reference.

ORDER

It is hereby ordered that the unfair labor practice complaint, filed by IBU against WSF and docketed as MEC Case No. 6-95 is dismissed.

WASHINGTON STATE FERRIES/INLANDOBATMEN’S UNION GRIEVANCE SETTLEMENTS

RICHMOND, IBU #95-21:

On a non-precedential basis, WSF agrees to pay Larry Richmond one day’s pay at the AB rate, plus reinstating one day of vacation and one day of comp time.

PEARSON/HOUGEN, #94-123 AND #94-125:

On a non-precedential basis, the IBU agrees to withdraw these grievances.

WEGER, #95-52; MEC CASE NO. 6-95; TWEIT/CLARK, #95-65; TWEIT/CLARK, 95-81; SHEFFIELD, 95-55; GRIEVANCE OF CRAIG SABATININ (if timely filed):

MEC case no. 6-95 shall be dismissed by the IBU. The issues in all of the above cases shall be resolved in a single arbitration, from an FMCS list.
