THIS MATTER came before the Marine Employees’ Commission for consideration of the International Organization of Masters, Mates & Pilots Motion to Dismiss MEC Case No. 7-90.

This request for grievance arbitration was originally scheduled for hearing before Dan E. Boyd, acting as arbitrator on behalf of the Marine Employees’ Commission on Thursday, August 2, 1990. On July 31, 1990, Captain Dave Boyle notified MEC he would be unable to attend the August 2, 1990 hearing, and subsequently MEC rescheduled to Monday, August 27, 1990. On August 8, 1990, Patricia Nightingale, on behalf of Washington State Ferries, notified MEC that the parties had settled. On August 9, 1990, Captain Dave Boyle confirmed by phone that the parties had reached settlement and MEC would receive written notice from MM&P. Following this notice, Arbitrator Boyd canceled the August 27, 1990 hearing.

Based upon the MEC’s receipt of written confirmation of settlement of the case from Patricia Nightingale for WSF on August 9, 1990, from Elton Eilert for WSF on August 14, 1990, and from Captain Dave Boyle for MM&P on August 14, 1990, it is hereby ORDERED, that the request for grievance arbitration filed by the Masters, Mates and Pilots (on behalf of Thomas Dennis) against the Washington State Ferries, MEC Case No. 7-90, is dismissed.
