On March 22, 1991, the Marine Engineers Beneficial Association, through James Webster, filed a request for grievance arbitration with the Marine Employees’ Commission. Chairman Dan E. Boyd was appointed hearing examiner and a pre-hearing conference was scheduled for April 9, 1991. Notice of Hearing was served April 18, 1991, setting hearing dates of May 29, 30 and 31 in this matter. On May 8, 1991, the MEC served a notice granting a continuance of the hearing dates to June 10, 11 and 12, 1991.

Prior to the convening of the hearing on June 10, 1991, the parties informed the hearing examiner that they had resolved all of the issues in this matter and had entered into a settlement of the case.

The parties stipulated on the record that the settlement concerns people who have been assigned to two vessels, the Nisqually and the Hiyu, and the terms of the settlement specify the manner in which people are to be treated both retroactively and prospectively. The parties further stipulated on the record that the purpose of the agreement is solely to resolve this grievance without establishing any precedent. The agreement shall not be admissible in any subsequent proceeding or negotiations between the parties except to enforce its terms.

After due consideration of the settlement agreement and in accordance with the request of all parties, the settlement agreement is approved.

Pursuant to the withdrawal of the request for grievance arbitration (WAC 316-65-538) by Grievant MEBA, it is hereby ordered that MEC Case No. 1-91 is hereby dismissed.
