In the matter of the petition of:

Washington sTate Council of County and CIty Employees

Involving certain employees of:

City of Moses LAke

CASE 134362-E-21

DECISION 13423-A - PECB

FINAL CERTIFICATION

Bill Keenan, Director of Organizing, for the Washington State Council of County and City Employees.

Colin R. Boyle, Attorney at Law, Summit Law Group PLLC, for the City of Moses Lake.

On July 30, 2021, the Washington State Council of County and City Employees filed a petition to represent certain employees of the City of Moses Lake. After an investigation, the Public Employment Relations Commission (PERC) determined that a card check could be conducted and reserved the eligibility challenges for a subsequent determination. The tally indicated that the Washington State Council of County and City Employees was entitled to certification and the eligibility issues did not affect the outcome of the card check. PERC issued an interim certification in City of Moses Lake, Decision 13423 (PECB, 2021) and conducted further proceedings to resolve the eligibility challenges.

Prior to a ruling, the parties resolved their differences. PERC has reviewed the parties’ resolution and determined that the resulting bargaining unit is appropriate under the statute. No further proceedings are necessary.

ORDER

1.                  The interim certification will stand as the final certification in this representation proceeding for the bargaining unit described as follows:

All full-time and regular part-time fleet management, building maintenance, sewer, stormwater/streets and water department employees at the City of Moses Lake, excluding supervisors, confidential employees, clerical employees, and all other employees.

2.                  The above-captioned matter is CLOSED.

ISSUED at Olympia, Washington, this  31st  day of January, 2023.
