CASE 132063-E-19
DECISION 13097-B - PECB
FINAL CERTIFICATION |
Paul Marvy, Projects Administrator, for the petitioner, PROTEC17.
Paul A. Olsen and Tamara Gerrard, Assistant City Attorneys, for the employer, City of Seattle
On August 28, 2019, PROTEC17 filed a representation petition with the Public Employment Relations Commission (PERC) involving certain employees of the City of Seattle. After an investigation, PERC determined that a card check could be conducted and reserved the eligibility challenges for a subsequent determination. The tally indicated that PROTEC17 was entitled to certification and the reserved eligibility challenges did not affect the outcome of the card check. An interim certification was issued in this matter, City of Seattle, Decision 13097 (PECB, 2019), and the proceeding was held open to resolve the eligibility challenges.
After a hearing, the Executive Director determined the challenged position was a confidential employee and should be excluded from the bargaining unit. City of Seattle, Decision 13097-A (PECB, 2020). The Executive Director’s decision was not appealed.
ORDER
1. The interim certification issued in this matter will stand as the final certification in this representation proceeding for the bargaining unit described as:

2. The above-captioned matter is CLOSED.
ISSUED at Olympia, Washington, this 30th day of July, 2020.
