Washington State Department of Corrections, Decision 13198 (PSRA, 2020)
STATE OF WASHINGTON
BEFORE THE PUBLIC EMPLOYMENT RELATIONS COMMISSION
In the matter of the petition of: TEAmsters local 117 Involving certain employees of: washington state department of corrections |
CASE 132608-E-20 DECISION 13198 - PSRA CERTIFICATION |
Eamon McCleery, Staff Attorney, for Teamsters Local 117.
Tanya Aho, Labor Negotiator, Office of Financial Management, for the Washington State Department of Corrections.
Findings of Fact
1. Teamsters Local 117 filed a representation petition concerning the Budget Analyst 3 & 4 at the Washington State Department of Corrections. The Public Employment Relations Commission (PERC) determined the petition was timely filed and accompanied by a sufficient showing of interest. No other organization has claimed to represent the employees involved.
2. The existing bargaining unit, last certified in Washington State Department of Corrections, Decision 13176 (PSRA, 2020), represented by the Teamsters Local 117 is described as follows:
All nonsupervisory classified employees of the State of Washington working for the Department of Corrections in correctional institutions, the correctional industries program, the sex offender treatment program, and regional business service center, excluding persons exempt from the coverage of chapter 41.06 RCW, employees in the Washington Management Service, confidential employees, supervisors, institutions employees in historically excluded groups that have not been modified by subsequent orders, and all other employees of the employer.
3. Because the more than 50 percent showing of interest threshold was met, PERC conducted card check proceedings. The employees were given a free choice in the proceedings. The tally of results was provided to the parties. No meritorious election objections have been filed.
4. The existing bargaining unit represented by the Teamsters Local 117 shall be modified to include the employees in the Budget Analyst 3 & 4 job classes for a bargaining unit described as follows:
All nonsupervisory classified employees of the State of Washington working for the Department of Corrections in correctional institutions, the correctional industries program, the sex offender treatment program, and regional business service center, excluding persons exempt from the coverage of chapter 41.06 RCW, employees in the Washington Management Service, confidential employees, supervisors, institutions employees in historically excluded groups that have not been modified by subsequent orders, and all other employees of the employer.
Conclusions of Law
1. The unit described in finding of fact 4 is an appropriate unit within the meaning of RCW 41.80.070.
2. Representation proceedings were conducted in accordance with RCW 41.80.070 and chapter 391‑25 WAC.
