                                                       STATE OF WASHINGTON

BEFORE THE PUBLIC EMPLOYMENT RELATIONS COMMISSION

In the matter of the petition of:

PROTEC17

Involving certain employees of:

KING COUNTY

CASE 132051-E-19

DECISION 13156-A - PECB

FINAL CERTIFICATION

Paul Marvy, Projects Administrator, for the petitioner, PROTEC17.

Robert S. Railton, Deputy Director of Labor Relations, for the employer, King County.

On August 21. 2019, PROTEC17 filed a representation petition with the Public Employment Relations Commission involving certain employees of King County. After an investigation, PERC determined that a card check could be conducted and reserved the eligibility challenges for a subsequent determination. The tally indicated that PROTEC17 was entitled to certification and the reserved eligibility issues did not affect the outcome of the card check. An interim certification was issued in this matter, King County, Decision 13156 (PECB, 2020), and the proceeding was held open to resolve the eligibility challenges.

Prior to a ruling, the parties informed the Executive Director that they had resolved their differences. The parties’ resolution has been reviewed and the resulting bargaining unit is appropriate under RCW 41.56.060. It therefore appears that all issues have been resolved and that no further proceedings are necessary.

                                                                       ORDER

1.                  The interim certification issued in this matter will stand as the final certification in this representation proceeding, except the bargaining unit shall be modified as follows:

All full-time and regular part-time nonsupervisory employees in the Project-Program Manager, Communications Specialist, Educator Consultant, Statistician, and Engineer job series who work for the King County Department of Community & Human Services in the following divisions: Performance, Measurement & Evaluation; All Home; Adult Services; Housing, Homelessness & Community Development; Director’s Office; Developmental Disabilities & Early Childhood Development; and Children, Youth & Young Adult Services. Excluding supervisors, confidential employees, employees in other bargaining units, and all other employees.

2.         The above-captioned matter is CLOSED.

ISSUED at Olympia, Washington, this  5th  day of May, 2020.
