DECISION 11324 - PECB

ORDER OF DISMISSAL

Audrey Eide, General Counsel, for the union.

Paula Itaoka, for the employer.

On July 1, 2011, the Washington State Council of County and City Employees (WSCCCE) filed a unit clarification petition seeking to include the position of “Planning Manager in Community Development” into an existing bargaining unit of employees that it represents at the City of Lynnwood.  On December 1, 2011, Representation Case Administrator Dario de la Rosa sent an e-mail to the parties asking for a status update on the case.  Later that same day, Bill Keenan, Director of Organizing for the WSCCCE, sent an e-mail to Mr. de la Rosa stating that he thought the petition had been withdrawn.  The agency has no record of WSCCCE withdrawing its petition.

On March 5, 2012, Executive Director Michael P. Sellars issued a show cause letter asking why the petition should not be dismissed in light Mr. Keenan’s December 1, 2011 communication.  Responses to the show cause directive were due March 12, 2012.

Neither WSCCCE nor the city responded to the Show Cause Directive.

NOW, THEREFORE, it is
