ORDER OF DISMISSAL

Jeffers, Danielson, Sonn and Aylward, by Stanley A. Bastian, Attorney at Law, appeared for the employer.

On October 27, 1995, the Chelan County Deputy Sheriffs’ Association (union) filed a petition under Chapter 391-35 WAC, seeking clarification of an existing bargaining unit which historically included all non-supervisory employees of the Chelan County Sheriff’s Department. The petition cited amendments to RCW 41.56.030(7) made effective July 1, 1995, as a basis for dividing the historical bargaining unit into three units, as follows: (1) A unit of commissioned law enforcement officers; (2) a unit of corrections personnel; and (3) a unit of support personnel.

Hearing dates were established by notices issued on January 30, 1996, and no less than four dates thereafter, but the parties repeatedly requested continuances for the purpose of attempting to resolve the matter bilaterally and/or based upon claim that the matter had been resolved. The history of the case, docket records concerning related cases, applicable rules, and applicable precedents were all reviewed in a letter directed to the parties on July 9, 1997, at which time a request for another continuance was denied and the parties were given a period of 14 days in which to identify what, if any, issue remained which would be appropriate to decide in the above-captioned unit clarification proceeding.

Nothing further was received from the parties, whereupon the Hearing Officer issued a letter on August 20, 1997 notifying the parties that a hearing scheduled for August 21, 1997 was cancelled and that the case would be dismissed.

NOW, THEREFORE, it is

ORDERED

The petition for clarification of an existing bargaining unit filed in the above-captioned matter is DISMISSED for lack of prosecution.
