ORDER OF DISMISSAL

Welch and Condon, by David Condon, Attorney at Law, appeared on behalf of the union.

Mary Brown, Labor Relations Coordinator, appeared on behalf of the employer.

On June 7, 1989, International Brotherhood of Electrical Workers, Local 483, AFL-CIO, filed a petition for clarification of an existing bargaining unit with the Public Employment Relations Commission, seeking to have the classification of "assistant hydro project manager" included in a bargaining unit of City of Tacoma employees represented by that organization.

The case was assigned to Hearing Officer Rex L. Lacy, who held a pre-hearing conference in the matter on February 27, 1990. The parties entered into settlement discussions at that time.

The union subsequently informed the Hearing Officer that the dispute has been resolved, and that the petition would be withdrawn. The Hearing Officer has made telephone contacts with the union on several subsequent occasions, and has been assured that the petition would be withdrawn. Documents evidencing that withdrawal were not forthcoming, however.

On August 17, 1990, the union was notified that, unless good cause was shown on or before August 31, 1990, why such action should not be taken, the petition in the above-entitled matter would be dismissed for lack of prosecution. No response has been received.

NOW, THEREFORE IT IS

ORDERED

The petition for clarification of an existing bargaining unit in the above matter is dismissed.
