ORDER OF DISMISSAL |
On November 17, 1986, International Association of Firefighters, Local 3062 (petitioner) filed a petition with the Public Employment Relations Commission seeking clarification of a bargaining unit of employees employed by King County Fire District No. 43 (employer). At issue was the bargaining unit status of an employee holding the position of "mechanic/firefighter".
A petition for investigation of a question concerning representation had been filed on October 10, 1986 involving the same bargaining unit. Docketed as King County Fire District No. 43, Case No. 6597-E-86-1155, that matter was assigned to a hearing officer for further processing. During the course of these proceedings, the parties filed an election agreement in which the description of the bargaining unit and a list of eligible voters was stipulated.
A unit clarification petition may not be processed where a question concerning representation exists. WAC 391-35-010. By stipulating to the existence of a question concerning representation and the definition of the bargaining unit in the representation case, the parties have made this unit clarification case moot.
ORDER
The petition seeking clarification of an existing bargaining unit filed in the above-captioned matter is hereby DISMISSED.
