ORDER DISMISSING CASE

On October 8, 2010, the Commission issued Omak School District, Decision 10761-A (PECB, 2010) finding that Omak School District (employer) committed an unfair labor practice by interfering with employee Weingarten rights in violation of Chapter 41.56 RCW. The employer’s subsequent motion for reconsideration of that decision was denied.
On December 28, 2010, the employer filed a petition for judicial review, and on August 11, 2011, the Thurston County Superior Court entered an order reversing the Commission’s findings and conclusions and remanded the case back to the Commission to dismiss. The decision of the Superior Court was not appealed.
ORDER
Pursuant to the Order of the Thurston County Superior Court, the complaint in the above-entitled action is DISMISSED.
