The above-named complainant filed a complaint charging unfair labor practices with the Public Employment Relations Commission in the above-entitled matter. The matter was previously reviewed by the Executive Director pursuant to WAC 391-45-110, and the complainant was directed in Port of Seattle, Decision 2549 (PECB, 1986) to file an amended complaint setting forth facts sufficient to state a cause of action against the union for its limitation of the group of employees eligible to vote on ratification of an agreement reached in collective bargaining. Nothing was received from the complaint within the time specified, and an order of dismissal, Port of Seattle, Decision 2549-A (PECB, 1986), was issued on October 31, 1986. Prior to the filing of a petition for review or the expiration of the period for filing of a petition for review, the complainant has filed a request with the Commission, seeking extension of the time for response. Having considered the matter, the Executive Director deems it appropriate to withdraw the order of dismissal and establish a new deadline for the filing of an amended complaint.
NOW, THEREFORE, it is
ORDERED
1. The order of dismissal issued as Decision 2549-A (PECB) on October 31, 1986 is hereby withdrawn.
2. The complainant will have until
December 1, 1986
to file additional facts sufficient to state a cause of action against the union for its limitation of the group of employees eligible to vote on ratification of an agreement reached in collective bargaining. In the absence of an amended complaint filed in the office of the Commission by that date, Case No. 6184-U-86-1171 will again be dismissed for failure to state a cause of action.
