An order was issued on November 17, 1982, dismissing a related matter and assigning the captioned matter to Examiner Alan R. Krebs. The complainant subsequently filed a petition for review concerning the order of dismissal in Case No. 4078-U-82-645, and that matter is currently pending before the Commission. Examiner Krebs scheduled a hearing in the matter for March 4, 1983. Examiner Krebs issued an order on January 7, 1983, requiring the complainant to make the complaint more definite and certain. The deadline established for a response was January 24, 1983, yet no response has been received. Recent developments concerning the availability of PERC staff members indicates a necessity to substitute a new Examiner. The Executive Director having considered the developments since November 17, 1982, and being satisfied that the previously scheduled hearing should be continued until other pending issues are resolved;

NOW, THEREFORE, it is

ORDERED

1.                  The assignment of Alan R. Krebs as Examiner is withdrawn. The parties will be notified when an Examiner is appointed.

2.                  The hearing previously scheduled for March 4, 1983 is postponed indefinitely pending a determination on the petition for review and disposition of matters relating to the order that the complaint be made more definite and certain.
