STIPULATED ORDER

COME NOW the parties, Complainant, Teamsters Local Union No. 117, by and through its attorney of record, ANNA A. JANCEWICZ, and Respondent, Department of Corrections, State of Washington, by and through its attorneys of record, ROB MCKENNA, Attorney General, and DAVID LA RAUS, Assistant Attorney General, and submit the following Stipulated Order in full and final resolution of the Amended Complaint in the above-captioned matter, stipulating and agreeing as follows:

(1)               The parties agree, and management will notify all supervisory and/or management staff at the Monroe Correctional Center, that an employee's designated shop steward representative will be allowed to participate and speak during representational activities as set forth in Article 7.1, consistent with the terms and limitations of Articles 8, 9 and 30 of the master agreement ("CBA") between the parties which becomes effective on July 1, 2005.

(2)               The parties agree to abide by Article 29.2 of the CBA and that no information relating to an employee's job performance, including, but not limited to, information regarding corrective or disciplinary action, will be placed in the official personnel file without providing a copy of that information to the employee, and Monroe Correctional Center Human Resources staff will be informed of this obligation by management.

(3)               The parties agree to adhere to the provisions of Article 9.7(A) of the CBA regarding the scheduling of Step 1 grievance meetings by providing seventy-two (72) hours notice to the grievant, and to his/her representative designated pursuant to Article 9.1 (E), prior to the date and time of the meeting.

Having considered the matter, the Hearing Examiner is satisfied that the parties have reached this agreement.

NOW, THEREFORE, it is

ORDERED

1.                  The parties' agreement as stated herein is accepted.

2.                  The Monroe Correctional Center, Department of Corrections, State of Washington, its officers and agents, shall post, in conspicuous places on its premises where notices to employees are usually posted, copies of this Order. This Order shall be and remain posted for 60 days. Reasonable steps shall be taken by the Monroe Correctional Center, Department of Corrections, State of Washington to ensure that said notices are not removed, altered, defaced or covered by other material.
