On March 3, 1986, Teamsters Local 760 filed with the Public Employment Relations Commission, a complaint charging unfair labor practices against the City of Moses Lake. On April 11, 1986, the city filed a motion to dismiss the complaint on the basis that it failed to meet the format requirements of WAC 391-45-050. The motion stated in part "no references are made [in the complaint] to times, dates, places or persons involved."
On April 25, 1986, the examiner required the complainant to file and serve a statement supplying information necessary to make the complaint definite and certain in accordance with WAC 391-45-250. The complainant was required to file the information within ten days. An amended complaint was not received within the time period provided.[1]
NOW, THEREFORE, it is
ORDERED
Case No. 6253-U-86-1196 is dismissed for failing to state a cause of action.
