Involving certain employees of:

ORDER CLOSING CASE

LINCOLN HOSPITAL DISTRICT #3

 

On March 23, 1992, Service Employees International Union, Local 6 filed a petition with the Public Employment Relations Commission seeking investigation of a question concerning representation among certain employees of Lincoln Hospital District #3. The petitioner and the employer thereafter entered into and filed an election agreement together with a supplemental agreement, by which issues concerning the eligibility of employees in the positions of X-Ray Technician, Respiratory Therapist/Public Relations Clerk, and Supervisor-Maintenance were reserved for subsequent resolution.

An election by secret ballot was conducted and an interim certification was issued in Lincoln Hospital District, Decision 4086 (PECB, 1992), for the bargaining unit described as:

All full-time, regular part-time and professional, technical, skilled maintenance, business office clerical and non-professional employees of the employer; excluding managers, supervisors, confidential employees, and casual employees.

The petitioner was thereby designated as the exclusive bargaining representative.

Prior to a hearing on the eligibility issues reserved in the supplemental agreement, the parties resolved the remaining eligibility disputes. It therefore appears that all issues that could have been addressed in the instant representation proceedings have been resolved, and that no further proceedings are necessary.

NOW, THEREFORE, it is

ORDERED

1.         The interim certification issued in Lincoln Hospital District #3, Decision 4086 (PECB, 1992) , will stand as the final certification in the instant representation proceeding.

2.         In light of the withdrawal of the issue previously framed herein, the matter is CLOSED.
