ORDER CLOSING CASE

CITY OF MEDINA

 

On February 3, 1992 Teamsters Union, Local 763 filed a petition with the Public Employment Relations Commission seeking investigation of a question concerning representation among certain employees of the City of Medina. The petitioner and the employer thereafter entered into and filed an election agreement together with a supplemental agreement, by which an issue concerning the eligibility of the Deputy Clerk was reserved for subsequent resolution.

An election by secret ballot was conducted and an interim certification was issued in City of Medina, Decision 4058 - PECB for the bargaining unit described as:

ALL MAINTENANCE, OPERATIONS AND OFFICE-CLERICAL EMPLOYEES OF THE EMPLOYER; EXCLUDING SUPERVISORS, CONFIDENTIAL EMPLOYEES AND ALL OTHER EMPLOYEES OF THE EMPLOYER.

The petitioner was thereby designated as the exclusive bargaining representative.

Prior to a hearing on the eligibility issues reserved in the supplemental agreement, the employer withdrew its claim that the employee at issue was properly excluded from the bargaining unit.

It therefore appears that all issues that could have been addressed in the instant representation proceedings have been resolved, and that no further proceedings are necessary.

NOW, THEREFORE, it is

ORDERED

1.         The interim certification issued in City of Medina, Decision 4058 - PECB, will stand as the final certification in the instant representation proceeding.

2.         In light of the withdrawal of the issue previously framed herein, the matter is CLOSED.
