This matter is before the Commission on appeal from a decision of the Executive Director. The Commission previously ruled on the timeliness of the appeal. See: Decision No. 395-B (PECB, 1978).

The case presents problems inherent in the situation of small municipalities operating through part time elected officials and full time, as well as part time, employees.

The Commission has reviewed the authorities cited by the employer in its brief on appeal. In our opinion the fire lieutenant is not a "confidential employee" within the meaning of the statute. His work with the mayor and his administrative assistant is largely ministerial. Any indicia of supervisory authority possessed by the fire lieutenant are so limited as to call for classification of the fire lieutenant as a leadman. The decision of the Executive Director is affirmed.
