ORDER CLOSING CASE

Perkins Coie, Thomas E. Platt, Attorney at Law, appeared on behalf of the employer.

Ken Crowder, President, appeared on behalf of the union.

The petition for the investigation of a question concerning representation was filed in the above-entitled matter on October 12, 1987. The parties entered into an Election Agreement and a Supplemental Agreement pursuant to the rules of the Commission. A representation election was conducted on November 1, 1988, and an Interim Certification was issued on November 9, 1988 (Decision 3012-A), designating the Snohomish County Deputy Sheriff's Association as the exclusive bargaining representative of:

NON-SUPERVISORY EMPLOYEES OF THE SHERIFF DEPARTMENT WHO ARE "UNIFORMED PERSONNEL" WITHIN THE MEANING OF 41.56 RCW; EXCLUDING ELECTED OFFICIALS, OFFICIALS APPOINTED TO OFFICE FOR A FIXED TERM OF OFFICE, SUPERVISORS AND CONFIDENTIAL EMPLOYEES.

On December 2, 1988, the employer filed written notice that it was withdrawing the issues reserved in the Supplemental Agreement, by inclusion of positions titled "lieutenant" in the bargaining unit. It therefore appears that there remains no current dispute concerning the selection of a bargaining representative or the allocation of positions or classifications to bargaining units.

NOW THEREFORE, it is

ORDERED

1.                  The withdrawal of the issues reserved in the Supplemental Agreement in the above entitled matter is accepted.

2.                  The certification issued on November 9, 1988, will stand as the certification of representation in this case.

3.                  The above-entitled matter is now closed.
