Involving certain employees of:

 

LAKE STEVENS-GRANITE FALLS TRANSPORTATION COOPERATIVE

ORDER DETERMINING CHALLENGED BALLOT

The Public Employment Relations Commission conducted a representation election in the captioned matter on August 6, 1986, pursuant to an order issued by the Commission on June 5, 1986, (Decision 2462 - PECB). An amended tally of ballots was issued on August 22, 1986, showing that there were 42 employees claimed eligible to vote including three persons who cast challenged ballots.

During the post-election period, it came to the attention of the Commission that one of the persons who cast a challenged ballot had submitted a letter of resignation to the employer, effective June 13, 1986. On September 16, 1986, the parties were ordered to show cause, on or before September 26, 1986, why the challenge to the ballot cast by that individual should not be sustained.

Teamsters Local 763 has filed a response to the show cause order, indicating that it has no objection to sustaining the challenge. Neither the employer nor Public School Employees of Washington has filed any response to the show cause order.

NOW, THEREFORE, it is

ORDERED

The challenge to the ballot cast by Phyllis Buckner is sustained and her name is stricken from the list of eligible voters in this proceeding.
