ORDER CLOSING CASE

On March 19, 1987, Teamsters Union, Local 760 (petitioner) filed a petition with the Public Employment Relations Commission seeking investigation of a question concerning representation among certain employees of the City of Omak (employer) working in the City's police department. The petitioner and the employer thereafter entered into and filed a cross-check agreement together with a supplemental agreement, by which issues concerning the eligibility of the Assistant Police Chief and the Sergeant were reserved for subsequent resolution.

A cross-check of employment and authorization records was made, and an interim certification was issued in City of Omak, Decision 2700 (PECB, 1987) for the bargaining unit described as:

All employees of the Omak Police Department, excluding the police chief and confidential employees.

The petitioner was thereby designated as the exclusive bargaining representative.

Prior to a hearing on the eligibility issues reserved in the supplemental agreement, the parties resolved the matters and submitted a written stipulation designating the disputed positions as supervisors. It therefore appears that all issues that could have been addressed in the instant representation proceedings have been resolved, and that no further proceedings are necessary.

NOW, THEREFORE, it is

ORDERED

1.                  The interim certification issued in City of Omak, Decision 2700 (PECB, 1987), will stand as the final certification in the instant representation proceeding.

2.                  In light of the stipulated resolution of the issues previously framed herein, the matter is CLOSED.
