STATE OF WASHINGTON

BEFORE THE PUBLIC EMPLOYMENT RELATIONS COMMISSION

In the matter of the petition of:

CASE NO. 5342-E-84-971

MONROE CLASSIFIED EMPLOYEES ASSOCIATION

Involving certain employees of:

DECISION NO. 2017 - PECB

MONROE SCHOOL DISTRICT

ORDER OF DISMISSAL

A petition for investigation of a question concerning representation was filed in the above-entitled matter on July 5, 1984. The petition indicates, on its face, that the employees in the petitioned-for bargaining unit were covered by a collective bargaining agreement between Public School Employees of Washington and the Monroe School District, and that said agreement is due to expire on August 31, 1984.

The petition was accompanied by a letter requesting that any problem with the date of filing of the petition be set aside, based on a claim that the petitioners did not receive a prompt response from the Commission to a May 16, 1984 request for information on a procedure for filing such a petition.

The petition was accompanied by a one page document containing signatures of employees who claimed a desire to be represented by the Monroe Classified Employees Association. WAC 391-25-110 provides:

The original petition shall be accompanied by a showing of interest indicating that the petitioner has the support of not less than thirty percent of the employees in the bargaining unit which the petitioner claims to be appropriate. The showing of interest must be timely filed under the same standards applicable to the petition, and must consist of individual authorization cards or letters signed and dated by employees in the bargaining unit claimed appropriate during the ninety day period preceding the filing of such evidence with the agency.

Questions of timeliness aside, the petition filed in this matter was not accompanied by a showing of interest conforming to the requirements of the rule, and must be dismissed on that ground.

ORDER

The petition for investigation of a question concerning representation is dismissed for failure to supply a showing of interest sufficient under the rules of the Commission.

DATED at Olympia, Washington, this 20th day of July, 1984.
