STATE OF WASHINGTON

BEFORE THE PUBLIC EMPLOYMENT RELATIONS COMMISSION

In the matter of the petition of:

WASHINGTON STATE COUNCIL OF COUNTY AND CITY EMPLOYEES

CASE 10168-E-92-1676

Involving certain employees of:

DECISION 4470 - PECB

CITY OF KENT

ORDER OF DISMISSAL

The above-captioned matter was initiated by a petition for investigation of a question concerning representation filed with the Public Employment Relations Commission on December 15, 1992. The case was one of five representation proceedings commenced at about that time by the Washington State Council of County and City Employees, involving employees of the City of Kent.[1]

As filed, the petitioned-for bargaining unit included only office-clerical employees in the Public Works Operations Division of the employer. As the result of pre-hearing conferences and election agreements filed by the parties, however, the five bargaining units set forth in the original petitions were modified. Employees from various departments were included in a multi-departmental office-clerical bargaining unit. The union thereupon ceased to pursue the separate bargaining unit originally sought in the above-captioned case, and there was no stipulation by the parties that such a unit would be appropriate.[2]

The Executive Director has considered the matter, and concludes that the above-captioned matter no longer raises a question concerning representation. It follows that the case should be stricken from the Commission’s docket of pending cases.

NOW, THEREFORE, it is

ORDERED

The petition for investigation of a question concerning representation filed in the above-entitled matter is DISMISSED.
