BEFORE THE PUBLIC EMPLOYMENT RELATIONS COMMISSION

In the matter of the petition of:

For determination of a dispute concernng union security arising under a collective bargaining agreement between:

SPOKANE EDUCATION ASSOCIATION

ORDER OF DISMISSAL

AND

 

SPOKANE SCHOOL DISTRICT

 

The above-named petitioner having, on November 14, 1983, filed a petition with the Public Employment Relations Commission for determination of a dispute concerning union security arising under a collective bargaining agreement between the Spokane Education Association and Spokane School District, and the Executive Director having assigned the matter to a Hearing Officer for further proceedings; and the petitioner having filed a written request to withdraw the petition; and the Executive Director having considered the matter;

NOW THEREFORE, it is

ORDERED

1.                  The petition for determination of a dispute concerning union security arising under a collective bargaining agreement between Spokane Education and Spokane School District, filed in the above-entitled matter is dismissed, with prejudice.

2.                  If no petition for review of this order is filed with the Public Employment Relations Commission within twenty (20) days following the date of this order, Spokane School District shall thereafter remit to Spokane Education Association in accordance with WAC 391-95-310, any and all funds withheld and retained pursuant to WAC 391-95-130 from the pay of David W. Dengler.

3.                  If a petition for review of this order is filed with the Public Employment Relations Commission, such filing shall automatically stay the effect of this order pending a ruling by the Commission.
