ORDER VACATING DISMISSAL

The Commission acted upon its own motion in dismissing the above-captioned case on September 1, 2004, and now acts on its own motion to reinstate the processing of the case. By this action, the Commission does not rule on its jurisdiction and/or the continued applicability of ­WAC 391-35-026, and the parties are entitled to argue or stipulate any such issues in the reinstated proceedings.

NOW, THEREFORE, it is

ORDERED

The order of dismissal issued in the above-caption case is VACATED.
