On March 23, 1999, the Pullman School District Building Secretaries (Union) filed a complaint with the Public Employment Relations Commission alleging that the Pullman School District (employer)had committed unfair labor practices under Chapter 41.56 RCW. Specifically, the complaint concerns the employer’s refusal to bargain in good faith about secretaries checking students for head lice, and about school closure/emergency leave.
On March 30, 1999, the employer notified the Commission that it had not been served with a copy of the complaint as required by WAC 391-45-030.The union did not respond to that claim in this case, and instead filed another case. A Deficiency Notice was issued on May 10, 1999, the union was notified that the complaint, as filed, did not state a cause of action because it was not properly served. The complainant was given 14 days in which to file and serve an amended complaint, or face dismissal of the complaint. Nothing further has been received from the complainant.
NOW, THEREFORE, it is
ORDERED
The complaint filed in the above-captioned matter is DISMISSED.
