WASHINGTON STATE – EMPLOYMENT SECURITY

and

WASHINGTON FEDERATION OF STATE EMPLOYEES

ORDER OF DISMISSAL

On January 30, 2006, Janice Stowe filed an unfair labor practice complaint against the Washington Federation of State Employees. The complaint designated the matter in dispute as the complainant’s eligibility to assert a right of nonassociation. On March 27, 2006, the Commission issued a preliminary ruling stating that a cause of action existed. On June 15, 2006, the respondent informed Examiner Dianne Ramerman by letter that the respondent had granted the complainant the right of nonassociation. On June 26, 2006, Examiner Ramerman sent a letter to the complainant requesting the complainant to withdraw the petition.

On July 18, the case was assigned to the present Examiner. This Examiner sent the complainant a letter renewing the request for a withdrawal. The letter, dated July 20, 2006, asked for the withdrawal’s submission by August 4, 2006, stating that if no withdrawal was received by that date, this Examiner would dismiss the petition. As of the date of this order, the complainant has not submitted a withdrawal.

The Washington Federation of State Employees has granted Janice Stowe her requested right of nonassociation. No reason exists for an evidentiary hearing on this matter.

NOW, THEREFORE, it is

ORDERED

The complaint charging an unfair labor practice filed in this matter is DISMISSED.

ISSUED at Olympia, Washington, this 23rd day of August, 2006.
