Perkins Coie, by Lawrence B. Hannah, Attorney at Law, for the employer.
Following the issuance of a Direction of Election in the above-captioned matter,[1] the City of Everett (employer) challenged all of the ballots cast in the election and filed objections on September 15, 2005, seeking to overturn the Direction of Election. The parties filed briefs with the Commission.
On April 6, 2006, prior to any further action by the Commission, the employer and International Association of Fire Fighters, Local 46 (union) jointly filed requests to withdraw the employer’s objections and the union’s petition. Upon considering the joint request at its meeting held on April 10, 2006, the Commission accepted the withdrawal of the objections. In the absence of any pending objections under WAC 391-25-590, the case reverts to the Executive Director for the issuance of the appropriate order.
NOW, THEREFORE it is
ORDERED
1. The ballots cast in the representation election in the above-captioned matter are voided and impounded without tally.
2. The request of International Association of Fire Fighters, Local 46, for withdrawal of the representation petition in the above-captioned matter is accepted, and the case is CLOSED.
