On September 10, 2002, Patrick Kelly filed a petition for investigation of a question concerning representation with the Public Employment Relations Commission under Chapter 391-25 WAC, seeking certification of corrections captains within the Pierce County Sheriff’s Department. The petition and showing of interest did not indicate the name of the union seeking certification.
A letter was sent to the petitioner on September 13, 2002, noting the defects that prevented further processing of the case. In particular, it was pointed out that WAC 391-25-110 requires that a petition filed by employees or an employee organization shall be accompanied by a showing of interest indicating that the petitioner has the support of thirty percent or more of the employees in the bargaining unit which the petitioner claims to be appropriate.
The petitioner was given a period of ten days in which to show cause why the petition should not be dismissed. The petitioner did not respond within the allotted time and therefore, the petition must be dismissed.
NOW, THEREFORE, it is
ORDERED
The petition for investigation of a question concerning representation filed in the above captioned matter is DISMISSED.
