ORDER OF DISMISSAL

On May 5, 2000, the Oroville Police Guild (union), filed a petition for investigation of a question concerning representation with the Public Employment Relations Commission under WAC 391-25 seeking to represent all of the employees in the police department. An investigation conference was conducted on June 13, 2000, by telephone conference call. A statement of results of the investi­gation conference was issued the same day, indicating the stipula­tions made by the parties during the conference. While certain matters were resolved during the course of the conference, three issues remained in dispute: (1) Whether the petitioner is a qualified labor organization; (2) whether the police chief should be excluded from the unit as a supervisor; and (3) whether the police chief had inappropriate involvement in union organization activities.

A notice of hearing was issued by Hearing Officer, Paul T. Schwendimen, scheduling a hearing for July 6, 2000.Prior to the opening of the hearing, the union announced its intention to withdraw its petition. Nothing further has been received from the union, however.

Several telephone contacts have been made with the union since July 6, 2000, requesting its withdrawal be confirmed in writing. On August 22, 2000, the union was given a period of 14 days to show cause why the petition should not be dismissed. No response has been received from the petitioner. The petition must be dismissed.

ORDERED

The petition for investigation of a question concerning representa­tion filed in the above-captioned matter is hereby DISMISSED.
